Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your use of Emperor, an AI photo and video generation platform (the "Service"), operated by [Company Legal Name] ("Emperor," "we," "us"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

2. Eligibility

You must be 18 or older to use Emperor. By creating an account, you confirm that you meet this requirement. We rely on your own attestation of this at sign-up; providing false information is a violation of these Terms and grounds for immediate termination.

3. Your Account

You're responsible for maintaining the security of your account and for all activity that happens under it. Authentication is handled by our identity provider (Clerk); we don't store your password ourselves. Let us know immediately if you believe your account has been compromised.

4. Reference Images & Your Content

Emperor lets you upload a reference photo and generate new images or video based on it. By uploading any photo, you confirm that you own the rights to it, or have the explicit consent of the person depicted, to use it this way. You may not upload a photo of someone else without their permission, and you're solely responsible for the reference images and prompts you submit.

You own the images and video you generate through Emperor, subject to your plan's usage terms and to the rights of anyone depicted in your reference images. We don't claim ownership of your generations. We do retain a limited license to store and process your content solely to operate and improve the Service.

5. Prohibited Uses

You may not use Emperor to create, upload, or attempt to generate content that:

  • depicts real minors in any sexualized or exploitative context — zero tolerance, no exceptions
  • uses another real person's likeness without their consent
  • depicts non-consensual sexual content of any kind
  • is intended to deceive, defame, harass, or impersonate someone without disclosure
  • violates any applicable law, or infringes someone else's intellectual property rights
  • attempts to bypass, probe, or disable our content-moderation systems

Every prompt and every generated image or video passes through automated content moderation before delivery. We may hold, reject, or remove content — and suspend or terminate accounts — that violates this section, at our discretion.

6. AI-Generated Content

Emperor generates images and video using third-party AI models (including from xAI, OpenAI, and fal.ai). Your prompts and reference images are sent to these providers to produce results. Generated content can be inaccurate, unpredictable, or occasionally fail outright — failed generations are automatically refunded in credits, but we don't otherwise guarantee any particular output.

7. Subscriptions, Credits & Payment

Paid plans are billed through Stripe on a recurring monthly or yearly basis until canceled. Credit packs are one-time purchases. Credits don't expire, but they have no cash value and aren't refundable or transferable, except where required by law. You can cancel a subscription any time from your billing page — your access continues through the end of the period you've already paid for.

8. Termination

You can stop using Emperor and delete your account at any time. We may suspend or terminate your account if you violate these Terms, including the prohibited-uses section above. Some provisions of these Terms — including ownership, disclaimers, and limitations of liability — survive termination.

9. Disclaimers & Limitation of Liability

The Service is provided "as is," without warranties of any kind. To the fullest extent permitted by law, Emperor is not liable for indirect, incidental, or consequential damages arising from your use of the Service, or for content generated through it.

10. Changes to These Terms

We may update these Terms from time to time. If we make a material change, we'll update the date at the top of this page. Continuing to use Emperor after a change means you accept the updated Terms.
